The Transfer Act: Still Working, or Time to Retire?


At today's meeting, Doug Pelham moderated a panel that discussed Raised Bill No. 281, an Act Concerning Various Revisions to the Property Transfer Law, and Raised Bill No. 293, an Act Establishing a Released-Based Property Remediation Program, which will transition Connecticut to a release-based remediation program. Last year the Legislature made changes to the Transfer Act and mandated that a Working Group be formed to recommend further changes to streamline the Transfer Act. Those changes are reflected in Raised Bill No. 281. Notwithstanding, DEEP is also proposing legislation to implement a release-based program and sunset the Transfer Act by July 1, 2022.

About the Presenters

Doug Pelham is a principal of the firm and a member of the Commercial Real Estate Group and the Environment Group. Since 1992, Mr. Pelham has been a licensed professional engineer in the State of Connecticut. Mr. Pelham was admitted to the Connecticut Bar in 1998.

Mr. Pelham is also the Membership Director of CEF.

Beth Barton is a partner with the law firm of Day Pitney, resident in Day Pitney’s Hartford, Connecticut office. She has more than 30 years of experience in environmental and land use litigation, permitting and consultation, at the federal, state and local levels.

Sam Haydock has more than 35 years of experience in environmental and land-use consulting. He is a Principal in the firm, the Director of Business Development and Client Care for the Environmental Division at BL Companies.

Nancy Mendel, of Winnick Ruben Hoffnung Peabody and Mendel, LLC, has been practicing environmental law for close to thirty years, counseling private and public sector clients in transactional, permitting, compliance and enforcement matters in all areas of environmental law.

Graham J. Stevens is the Bureau Chief of the Bureau of Water Protection and Land Reuse – comprised of the Remediation, Land and Water Resources, and Water Planning and Management Divisions.

Nelson Walter has more than 30 years of experience in environmental remediation projects. He is a Vice President of Wood Environment and Infrastructure Solutions and his technical background includes a B.S. in Chemical Engineering from Rensselaer Polytechnic Institute and remediation of several large-scale remediation projects.
